主旨：轉知有關約用人員奉派以公（差）假擔任研習會之講座或講座助理，得否再支領講座鐘點費或講座助理鐘點費一案，請  查照。
說明：
一、依臺南市政府 103 年 9 月 15 日府人力字第 1030842289 號函辦理。
二、經查現行軍公教人員兼職費及講座鐘點費支給規定第 2 點第 1 款規定略以，各機關學校辦理研習會、座談會或訓練機構辦理訓練進修，其實際擔任授課人員，按有關標準支給講座鐘點費。而該支給規定關於擔任授課講座或講座助理部分，並無限制人員身分與資格，約用人員若實際擔任授課人員或講座助理，應由主辦或訓練機關（學校）就事實認定後，本權責依規定覈實支給鐘點費或助理鐘點費。
三、另約用人員係適用勞動基準法，查該法第 70 條第 6 款規定略以，雇主僱用勞工人數在三十人以上者，應依其事業性質，就左列事項訂立工作規則，報請主管機關核備後並公開揭示之......六、考勤、請假、獎懲及升遷......，爰依據「臺南市政府及所屬機關學校約用人員工作規則」第 41 條規定：「約用人員依法令規定應給公假者，工資照給，其假期視實際需要定之」，倘約用人員確因業務需要，依法令規定實際擔任授課講座或講座助理，各機關學校得本權責視實際需要核給公（差）假。
