主旨：轉知教育部函釋「有關代理教師初聘時未具各該教育階段、科（類）合格教師證，嗣於學期中取得該證，是否符合再聘之規定疑義乙案」，請  查照。
說明：
一、依據教育部 103 年 8 月 5 日臺教授國字第 1030070095 號函（如附件）。
二、查「中小學兼任代課及代理教師聘任辦法（以下簡稱本辦法）」第 3 條之 2 第 1 項規定，「中小學聘任三個月以上經公開甄選之代課、代理教師，其服務成績優良、符合學校校務需求，且具第三條第三項第一款資格﹝按：具有各該教育階段、科（類）合格教師證書﹞者，經教師評審委員會審查通過後得再聘之，並報主管教育行政機關備查；再聘至多以二次為限。」次查教育部 101 年 8 月 29 日臺國（四）字第 1010137769D 號令略以，「再聘」之適用對象，限於欲聘任學期之前一學期內，於同校擔任聘期 3 個月以上之代理（課）教師。
三、另依教育部 101 年 8 月 24 日臺國（四）字第 1010137769A 號函示略以，本辦法其意旨為將優質師資留在原校，及降低代理（課）教師、學校、縣（市）政府參加、辦理甄選之工作負荷。
四、據上，本案所詢代理教師新聘時未具各該教育階段、科（類）合格教師證，嗣於學期中取得各該教育階段、科（類）合格教師證，若具經公開甄選、服務成績優良、符合校務需求、前一學期於原校代理（課） 3 個月以上，且經教評會審查通過之條件，得適用再聘之規定。
