主旨：教育部函釋有關學校教職員申請留職停薪人員得否於復職同日辦理退休生效疑義一案，請 查照。
說明：
一、依教育部 103 年 8 月 12 日臺教人(四)字第 1030113295 號函辦理。
二、摘錄教育部補充說明如下：
(一)因病留職停薪人員得於復聘當日辦理退休之規範意旨，係以是類人員於留職停薪期間仍具學校教職員身分，是為適度保障其退休權益，爰從寬同意因病留職停薪人員得於辦理復職之當日退休。
(二)學校教職員因育嬰、侍親、進修及其他情事辦理留職停薪者，基於學校教職員退休條例第 2 條及其施行細則第 2 條所定現職專任有給之限制規定，則不適用上開復職當日退休生效之規定。
三、檢附教育部原函 1 份。
