主旨：函轉教育部函釋有關教師每學年得請家庭照顧假日數疑義，請  查照。
說明：
一、依教育部 103 年 7 月 7 日臺教授國字第 1030070270 號函辦理。
二、查教師請假規則第 4 條第 1 項規定略以：「教師之請假，依下列規定：(第 1 款)因事得請事假，每學年准給七日。其家庭成員預防接種、發生嚴重之疾病或其他重大事故須親自照顧時，得請家庭照顧假，每學年准給七日，其請假日數併入事假計算。事假及家庭照顧假合計超過七日者，應按日扣除薪給，其所遺課務代理費用應由學校支付。...」
三、復查公立高級中等以下學校教師成績考核辦法第 4 條第 3 項規定：「第一項第一款第四目、第二款第四目及第三款第七目有關事、病假併計日數，應扣除請家庭照顧假、生理假，及經醫師診斷需安胎休養者，其治療、照護或休養期間請假之日數。」據此，教師成績考核事、病假日數應扣除家庭照顧假之日數。
四、基上，如教師於同一學年已辦理七日之家庭照顧假登記，則無再核給家庭照顧假之適法性。
五、檢附教育部原函影本 1 份。
