主旨：轉知教育部函釋有關退休教育人員再任各級政府出資成立之公司是否應停止其領受月退休金及公保養老優惠存款利息權利等疑義，如說明，請查照。
說明：
一、依教育部 105 年 5 月 9 日臺教人(四)字第 1050041002 號函辦理。
二、有關旨揭疑義，仍應依學校教職員退休條例第 13 條、同條例施行細則第 38 條、第 45 條及該部 103 年 6 月 30 日臺教人(四)字第 1030086326B 號令規定辦理，倘退休教育人員再任創立基金由政府全額捐助成立之財團法人之職務，應停止領受退休金之權利及原儲存之優惠存款，俟再任原因消滅後回復。但再任之工作報酬每月未達委任第一職等本俸最高俸額及專業加給合計數額者（按：現為新臺幣 32,160 元），不在此限。
