主旨：檢送「公務員服務法第 13 條相關解釋彙整表」1 份，請查照並轉知所屬公務員切實遵守。
說明：
一、依據銓敘部 105 年 4 月 8 日部法一字第 10540842482 號函辦理。
二、監察院 105 年 1 月 11 日院台內字第 1051930034 號函提調查意見一－(六)略以，關於公務員違法兼職問題，顯示相關機關(構)對公務員服務法(以下簡稱服務法)第 13 條規定宣導不足，銓部及行政院人事行政總處(以下簡稱人事總處)允應對於公務員加強宣導違法兼職之相關法律規定，以維官箴。
三、查銓敘部為期公務員更加瞭解服務法相關規定，除持續透過編印銓敘法規釋例彙編分送各機關人事機構廣為宣導，並登載於銓敘部全球資訊網及全國人事法規釋例資料庫檢索系統，以供公務員查閱外，該部另彙整中央相關主管機關歷次針對服務法第 13 條規定所為之相關解釋，除登載該部全球資訊網外，並通函中央暨地方各主管機關，轉知所屬公務員切實遵守，本府前於 101 年 3 月 22 日以府人考字第 101023231 號函轉知在案。茲為避免公務員仍有因不諳服務法第 13 條第 1 項規定，而經營商業或投資違反適法要件致遭懲戒處分之情事發生，爰請再轉知所屬公務員切實遵守，以及利用各種集會加強宣導或於員工教育訓練辦理講習。
四、檢附前揭銓敘部原函影本及「公務員服務法第 13 條相關解釋彙整表」各 1 份，該彙整表可至本府公務入口公文附件下載區（ http://login.tainan.gov.tw/oda.aspx ）自行下載使用。
