主旨：有關教師待遇條例施行後中小學教師取得較高學歷改敘相關疑義，詳如說明，請查照。
說明：
一、依據嘉義縣政府 105 年 3 月 3 日府人任字第 1050040088 號函轉教育部 105 年 2 月 25 日臺教人(二)字第 1050004226 號函辦理。
二、旨揭疑義分述如下︰
(一)有關中小學教師於本條例施行前未經服務學校書面核准進修者，在本條例施行後應如何辦理改敘一節，查本條例第 10 條第 1 項規定，中小學教師在職期間經服務學校或主管機關基於教學需要，同意其進修、研究與其教學有關之知能，取得較高學歷者，依規定辦理改敘。是以，中小學教師未經學校同意自行前往進修於本條例施行後始取得較高學歷者，不得依上開規定辦理改敘；另依本條例第 10 條第 2 項規定，本條例施行前已取得學位者，得適用施行前之規定辦理改敘。爰中小學教師未經服務學校同意自行前往進修並於本條例施行前已取得學位者，得依本條例第 10 條第 2 項規定適用施行前之規定辦理改敘，並依本部 86 年 6 月 7 日台（ 86 ）人（一）字第 86049910 號函規定議處。
(二)有關教師自行前往進修後始向學校提出申請進修並經學校事後同意，得否依本條例第 10 條第 2 項規定辦理改敘一節，按本條例第 10 條中小學教師在職期間經服務學校或主管機關同意進修、研究取得較高學歷改敘之規定，不以事前同意為限，惟改敘時應已取得同意。又本條例第 10 條第 2 項規定，本條例施行前業經服務學校書面核准進修學位者，得適用施行前之規定辦理改敘。爰教師自行前往進修，於本條例施行後始取得學校同意者，尚不得依上開規定辦理改敘。
(三)另有關本條例施行後，學校或主管機關辦理改敘時，是否應重新審查其任職年資資料或逕依現支薪級提敘，及發現誤核薪級時，應如何處理等節，按本條例並未規定學校或主管機關辦理改敘時，應重新審查原敘薪級，爰宜由貴府本於權責卓處；另學校或主管機關辦理改敘時，如發現原敘薪級有誤，應依本部 96 年 5 月 30 日台人（一）字第 0960071229 號函規定，由貴府依行政程序法第 171 條、第 119 條及第 127 條等規定，本於權責審酌有無信賴保護原則之適用及行政程序法第 117 條不得撤銷之情事，並洽審計機關意見辦理。
(四)至有關中小學教師現敘薪點高於新學歷最高本薪薪點時，其薪級應如何敘定一節，依本條例第 10 條第 1 項規定，中小學教師取得較高學歷改敘薪級，受所聘職務等級最高本薪之限制。倘中小學教師取得較高學歷時所敘薪點高於所聘職務等級最高本薪薪點，仍敘原薪級；最高本薪則按其最高學歷依本條例附表一「教師薪級表」說明一規定辦理。
