主旨：有關教師申請國外進修留職停薪期間，倘業已修畢學分，惟尚未取得學位提前回國，得否於學期中提前申請回職復薪疑義一案，經教育部函復如說明，請查照。
說明：
一、依教育部 104 年 11 月 24 日臺教人(三)字第 1040160088 號函辦理。
二、查該部 103 年 10 月 13 日臺教人（三）字第 1030146521 號函略以：「按教育人員留職停薪辦法第 4 條第 2 項規定，教師申請留職停薪進修係由服務學校、主管教育行政機關考量業務或校務運作狀況依權責核准。第 5 條第 2 項規定，教師申請留職停薪之期間，應以學期為單位。第 6 條第 1 項規定，留職停薪人員除其他法律另有規定外，應於留職停薪期間屆滿之次日復職。但其留職停薪屆滿前原因消滅後，應即申請復職。次按該部於 103 年 5 月 12 日以臺教人(三)字第 1030064839 號函以，教育人員留職停薪辦法第 6 條第 1 項規定所稱『原因消滅』係指原申請留職停薪之原因事由已不存在，不待申請留職停薪期限屆滿或學期結束，應即申請復職。承上，有關教師申請留職停薪之期間，應以學期為單位，係為保障學生完整受教權，惟如其申請事由已不存在，應即申請復職。所詢教師提前完成論文繳交及等候成績通知期間，是否屬『原因消滅』事由，因涉服務學校、主管教育行政機關權責，請依個案事實適用法規秉權責核處。」。
三、綜上，教師如已修畢學分，惟因學校作業程序，尚未取得畢業證書，實難認定符合進修「原因消滅」並同意提前回職復薪。
