主旨：函轉教育部書函，有關支領月退休金教師亡故後，其長期居住大陸地區遺族因家屬生病須照顧而無法親自返臺領取月撫慰金疑義乙案，復如說明，請 查照。
說明：
一、依教育部 103 年 6 月 5 日臺教人（四）字第 1030075980 號書函辦理。
二、有關本案發放相關規定，說明如下：
(一)從寬認定：赴大陸地區長期居住之月撫慰金領受遺族如有於發放查驗期間因受傷或疾病致行動困難且長達 6 個月以上而無法親自返臺領取月撫慰金之情形，在合法、合情理前提下，保障其領受權益。亦即符合前開事由之對象為月撫慰金領受遺族者始從寬認定。
(二)無法從寬認定：長期居住大陸地區之月撫慰遺族於發放查驗期間因家屬生病須照顧而無法親自返臺領取月撫慰金之情事，自始即非依兩岸條例等相關法律從寬規範之適用範圍。
三、基於公教人員遺族月撫慰金發放相關規定一致性原則，其餘相關注意事項請依說明四之函文參照辦理。
