主旨：有關教育部重申國民中小學選用教科圖書應注意事項及宣導鼓勵教師設計教學教具案。
說明：
一、依據公平交易委員會 103 年 12 月 4 日公製字第 1030022296 號函、行政院公共工程委員會 103 年 12 月 24 日工程企字第 10300415900 號函及本部 103 年 2 月 7 日臺教授國部字第 1020136291 號函辦理。
二、有關國民中小學選用教科圖書應注意事項，及宣導鼓勵教師設計教學教具案，依據「公平交易委員會對於國民中小學教科書銷售行為之規範說明」第 10 點第 4 項第 2 款第 1 目規定：前項所定不當之金錢、物品或其他經濟利益，例示如下：「...(二)物品： 1.與使用特定教科書教學不具有直接關聯，即非教學時所必要之輔助教具。...。」
三、依行政院公平交易委員會 97 年 8 月 22 日公處字第 097113 號至 097115 號處分書提及，倘非屬與使用特定教科書於教學時具有直接關聯之輔助教具，即非教學時確有必要使用者；另所贈物品倘非屬教學時使用之教具者，當屬前開所稱不當物品。是以教科書出版事業提供教師之物品，應以教學時確有必要使用者為限。據此，倘教科書出版業者認定，所提供物品內容與使用特定教科書教學具有直接關聯而確有提供之必要，則應將之納入教科書內容，俾所有師生均有相同機會使用學習，而非於選書之際，方由業者自行任意決定提供之學校及對象，否則將造成不公平現象。
四、此外，為提升學生學習成效，鼓勵教師應本於專業原則，就課程教學內容進行設計教學使用工具，併予敘明。
