主旨：關於公教人員保險（以下簡稱公保）被保險人依法徵服研發替代役而留職停薪者，於第 3 階段役期留職停薪期間應參加之保險種類疑義一案，請查照。
說明：
一、依據銓敘部民國 103 年 6 月 18 日部退一字第 1033851350 號書函辦理，並檢附原函影本。
二、依法徵服研發替代役而留職停薪者，因其役期僅第 1 及第 2 階段屬於「服役年資」，第 3 階段役期（ 2 年）係屬「用人單位工作年資」，即用人單位與役男係屬簽訂契約之僱傭關係，爰研發替代役男於第 3 階段役期如係受僱於「不得參加公保之用人單位」，則須為其辦理參加勞工保險，退出公保；若該役男第 3 階段役期係受僱於「應參加公保之政府機關或公、私立學校」，應依公保法第 10 條第 2 項規定，選擇退保或自付全部保險費，繼續加保；一經選定後，不得變更。其選擇繼續加保者，不得再另參加勞保；其選擇退出公保者，應依前開勞保相關規定，參加勞保。
