主旨：第 14 任總統、副總統與第 9 屆立法委員選舉將屆，為創造乾淨選風、塑造清明行政環境，重申各機關（學校）應依法嚴守行政中立，請　查照。
說明：　
一、依據公務人員行政中立法暨本府 104 年 11 月 25 日第 231 次市政會議提示事項辦理。
二、本府 104 年 9 月 8 日府人考字第 1040893705 號、 9 月 29 日府人考字第 1040969897 號書函諒達。
三、第 14 任總統、副總統選舉與第 9 屆立法委員選舉將於明（ 105 ）年 1 月 16 日舉行，各機關學校應貫徹行政中立法之規定，加強宣導下列相關事項，營造一個公平的選舉環境，讓行政超然獨立，端正選風：
(一)秉持行政中立絕不利用行政資源做任何偏頗的支持，依據法令執行職務，不得對任何團體或個人（如政黨或候選人）予以差別待遇，忠實推行政府政策，保持行政中立，服務人民。
(二)各機關學校於選舉委員會發布選舉公告日起至投票日止之選舉期間，應禁止政黨、公職候選人或其支持者之造訪活動，並應於辦公、活動場所之各出入口明顯處所張貼禁止競選活動之告示。
(三)公務人員得加入政黨或其他政治團體。但不得兼任政黨或其他政治團體之職務。不得利用職務上之權力、機會或方法，使他人加入或不加入政黨或其他政治團體；亦不得要求他人參加或不參加政黨或其他政治團體有關之選舉活動。
(四)公務人員不得為支持或反對特定之政黨、其他政治團體或公職候選人，從事行政中立法第 9 條所定之政治活動或行為。
(五)公務員不得利用職務上之權力、機會或方法，要求他人上網連結臉書等社交網站、加入公職候選人粉絲團、支持特定政黨、政治團體或公職候選人，亦不得具銜或具銜且具名針對討論主題發表言論；又無論著作書籍、於社交網站發言或於報紙投書，均應絕對保守政府機關機密，未經長官許可，不得以私人或代表機關名義任意發表有關職務之談話。
四、有關公務人員行政中立法及該法施行細則、公務人員行政中立法 Q＆A 專輯、「100 年公務人員行政中立訓練講座座談會提問及銓敘部研處意見彙整表」等相關規定及釋示，業已掛載於本府人事處網站（ http://www.tainan.gov.tw/personnel/）－考訓科－其他－行政中立/公務倫理專區，請自行下載運用。
